Our client was walking across a street with a “walk” sign when an 85-year-old man driving a pickup truck failed to yield the right of way and struck her. She suffered bilateral fractures of her wrists that required surgical implantation of hardware. Medical testimony established the development of post-traumatic arthritis and future damages that would include eventual surgical fusion of her wrists. On deposition, the pickup driver acknowledged that our client had a “walk” sign, but said the accident was her fault. “She should have seen me coming.” The case settled at mediation.
