PLEASE NOTE: TERRY BRYANT IS NO LONGER ACCEPTING NEW AVANDIA CASES.

In order to file an Avandia lawsuit, a number of important documents and criteria must be met in a timely fashion. The prescriptions must be verified, and the length of time the drug was taken is considered. Medical professionals will be needed to study the case history, side effects and medical records. A drug injury lawyer with experience in drug injury cases can help with the entire process, and many already know qualified medical professionals who can testify in this area.

HOW TO FILE A SUCCESSFUL AVANDIA LAWSUIT FOR DIABETIC PATIENTS

A diabetic who has used rosiglitazone, sold under the name Avandia, to relieve symptoms should consider filing an Avandia lawsuit. Avandia is a sensitizer that makes cells more responsive to insulin so the body can better use the insulin it produces. However, rosiglitazone also has been shown to have a number of risks.

Possible Side Effects of Taking Rosiglitazone

The possible side effects of taking rosiglitazone include heart failure, bone fractures, back pain, weight gain, retinal vein blockage, and difficulty breathing. It is estimated that rosiglitazone has caused over 100,000 cardiac arrests. Though suspended in Europe, it is still available in the United States.

Avandia’s Risk of Complications May Have Been Covered Up by Manufacturer

The maker of this drug, GlaxoSmithKline also known as Glaxo, is said to have been involved in a cover-up of these side effects, according to a 2012 article published by the New York Times. The results of some studies were withheld from the public according to this article. Subsequently, many who have suffered complications are seeking to file lawsuits.

These cases fall into a number of categories, including medical malpractice, product liability or drug injury.  Although the results differ according to the merits of each case, the success rate of an Avandia lawsuit is favorable. Over 13,000 individuals and families have filed suits, while more than 11,500 of them received compensation. Plaintiffs have received redress for pain, suffering, lost wages, and the cost of medical bills.

A medical report known as RECORD, which is the acronym for Rosiglitazone Evaluated for Cardiac Outcomes and Regulation (of Glycaemia) in Diabetes, indicated that the drug was safe and worked better than other comparable prescriptions. The Food and Drug Administration, however, found that the report did not show the results of some tests that indicated an increase in cardiac ischemia among patients receiving rosiglitazone. This means that the coronary artery is suddenly blocked so that the muscle of the heart cannot pump efficiently, which may bring about a heart attack.

A report published by the Senate Finance Committee indicated that Glaxo knew about the risks of this drug long before they were made publicly available. The report was named, “The Intimidation of Dr. John Buse and the Diabetes Drug Avandia.” This name refers to efforts made by Glaxo to stop a scientist who was researching the risks of this drug.
