Determining Your Eligibility
There are two requirements you must meet before you apply for workers’ compensation benefits. Your employer must have insurance coverage under the Texas Workers’ Compensation Act, and you must have suffered an illness or injury that’s related to your job.
Filing a Claim
Timelines:
When you’ve been injured on the job, even if the accident was your own fault, it is your responsibility to report your injury or illness to your employer within 30 days. Then, it is your employer’s responsibility to file an Employer’s First Report of Injury or Illness with your insurance carrier within eight days of your notification or absence from work.
Benefits:
Medical Treatment—You may receive compensation to cover your medical expenses and treatment, but for only work-related injuries. These benefits are paid directly to the medical provider.
Lost Wages—You may receive a portion of your lost wages through workers’ compensation income benefits. These benefits are calculated by your average weekly wage (AWW), which is based on your average earnings for 13 weeks if you’re a full-time employee.
Determining Disability
If your work-related injury or illness keeps you from being able to return to work or adjust to new work for more than a year, you may qualify for Social Security Disability benefits.
Filing a Lawsuit
If your employer is a nonsubscriber and doesn’t have workers’ compensation insurance that’s approved by the Texas Department of Insurance’s Division of Workers’ Compensation, you may sue your employer for compensation for your injuries. Also, if your employer does have coverage but your claim was denied, you may appeal the decision.
